AAPS Executive Director, Jane Orient, MD, Speaks to Business School Students

From talk given at the University of Virginia, Darden School of Business, on November 8, 2009.

Many people assert that the current occupant of the White House has broken the promises that he made on his previous campaign. He has breached pledges of consistency, “transparency” and not passing life-changing legislation into law before debate. Practices he frowned upon he now performs with zeal. In fact, the current occupant in the White House has kept his original campaign promise made at the out set of his campaign. He pledged to sacrifice everyone and he is living up to that pledge. He believes that the common good comes before that of the individual and the Congress acquiesces producing legislation with this notion in mind the opposite of individual rights.

Total commitment to the philosophy of abject self-sacrifice or altruism means all values become a target for sacrifice. Any promise, which he made after the original promise to sacrifice all to all, will also wind up as a sacrifice. He willingly includes sacrificing his integrity, consistency, honesty, his reason, and, of course the truth. He even sacrifices his perceptions. All life promoting values and virtues are null and void in keeping his eye on the moral code of abject self-sacrifice. In fact, he values nothing. He is the voice of destruction for America. Hence the massive contradictions on a daily basis He follows the idea that what is true today is not necessarily true tomorrow. (Perhaps two and two are not really four with this kind of mentality). The current occupant of the White House sees himself as the collector and re-distributor of the sacrifices-like a monarch or a tyrant take your pick. It is his responsibility, he claims, to provide jobs, healthcare, education and retirement to us all. Of course, this is not his job description.

The moral foundation of the United States is not altruism or self-sacrifice. The foundation of the United States consists of each individual having the right to his life, liberty, property and the pursuit of happiness. In order to exist with one another in peace, each individual freely trades value for value by mutual consent to mutual advantage with no sacrifices either way. The government as the Founding Fathers created it stands only to protect these rights. Government only exists to defend the individual rights of its citizens who freely consent to a government willing to retaliate against those who violate individual rights by force or fraud. The government exists to defend against domestic gangsters and foreign tyrants who wish to violate individual rights and private property. A proper government never initiates force against its citizens to violate their rights no matter how compelling the alleged emergency.

The current occupant of the White House does not believe any of the values of the Founding Fathers. He believes in the initiation of force to solve alleged social problems (healthcare in particular) with the consent of Congress. Not willing to send in the troops with fixed bayonets to openly confiscate the property and lives of physicians, since that would reveal too much of himself, he will get his supporters in the Congress to create a frenzy in the willing media and to pass a law that effectively sanitizes his willingness to use the bayonet solution. Once the law is passed it offers the same result as the bayonet fixed and pointed at the victim. In the case of healthcare the victims are the physicians, and other providers of healthcare, who he also intends to enslave. Ultimately the recipients of this government coerced alleged healthcare would be sacrificed as well. Rationing will ensue simply because not enough providers exist to meet the demand. It will appear that the voters or the electorate sanctioned this atrocity by the vote, but the Founders knew better and set up the government so that the majority could not vote to carve up the next door neighbor with that fixed bayonet.

During the 1960’s, when healthcare had almost no coercive government intrusion, my father had two major surgeries in the space of three years. Through his employer, he had what was called a Major Medical policy from Blue Cross & Blue Shield. I never hear him squawk about the cost. He received high quality care and returned home and to work in a matter of weeks. My mother had a similar surgical experience in 1959. She nearly died from a hospital-generated infection. A specialist in treating such infections visited her on a consult and saved her life with another surgery and appropriate antibiotics. Without the government meddling, people had the freedom to act on their own behalf. This will not be the case with more government coercion. The right to act on your own behalf will cease.

Government legislation for coerced medical care first surfaced in the early 1960’s as the proposed widespread intrusion under the King-Anderson Bill. Many physicians opposed this intrusion. One brave physician in particular, Dr. J. Bruce Hendrickson proposed a strike by New Jersey physicians by refusing to accept any coerced government money. Instead he offered what all well-meaning rational physicians offered. If the patient could not afford the healthcare then payment could be reduced or the doctor could voluntarily donate the services. Many physicians engaged in this practice because
free men are more likely to be magnanimous. Harry S. Truman, who first proposed the idea of government-coerced healthcare, when asked what he thought of the potential physician strike in New Jersey on May 10, 1962, responded in
this way: “ I think that they should be hit over the head with a club.” This represents the ugly face of healthcare offered at the point of a bayonet, or in Truman’s case, a club.

Today Truman’s heirs will offer us one payer and hence one provider healthcare or Livestock Healthcare to make us equal with the animals. It is no accident that Peter Singer, bio-ethicist, and animalist (someone who thinks animals & humans have equal moral standing), popped his head out of his burrow in the Ivy League, after conferring with his team of badgers to snarl in favor of healthcare rationing.

Animalists believe in the moral equality of humans and animals. The present occupant in the White House, given Singer’s moral sanction, will offer no attempts at rational persuasion. Reason according to the Animalists is an irrelevant characteristic. Instead, we will get the same quality of health care as livestock--down on all fours and collars around our collective necks. Perhaps this represents a more efficient way to deliver medications or maybe that bayonet. If you are a favorite, in the now politicized healthcare by bayonet, and your position in the livestock herd improves you become a pet and receive favored care. If you cause trouble, your status drops to pest with all the consequences that will follow from that designation.

The proposed programs represent an attempt by the Congress and the current occupant in the White House, to experiment on the total American patient population without informed consent. The CDC, under Franklin D. Roosevelt’s Administration initiated such research, which produced such atrocities as the Tuskegee Institute syphilis study on black adults. In the 1940’s the remedy for this disease consisted of a penicillin injection, which physicians participating in this study denied to the patients, rationalizing that penicillin was an unproven remedy. Sounds like a rationalization the current crowd might use to “cut costs.” The infamy of that led to legislation, producing such laws as in the 45 CFR 46

§ 46.116 General requirements for informed consent. Except as provided elsewhere in this policy, no investigator may involve a human being as a subject in research covered by this policy unless the investigator has obtained the legally effective informed consent of the subject or the subject's legally authorized representative. An investigator shall seek such consent only under circumstances that provide the prospective subject or the representative sufficient opportunity to consider whether or not to participate and that minimize the possibility of coercion or undue influence. The information that is given to the subject or the representative shall be in language understandable to the subject or the representative. No informed consent, whether oral or written, may include any exculpatory language through which the subject or the representative is made to waive or appear to waive any of the subject's legal rights, or releases or appears to release the investigator, the sponsor, the institution or its agents from liability for negligence.

Those promoting this fiasco admit and with an arrogant false pride that they have not even read any of the proposed legislation. However will they give us informed consent if they are ignorant of their own experiment?

Once the present White House occupant runs all the private insurance companies out of business he will claim that they caused the problem because of their greed for selfish profits. In fact, the problems with healthcare in the economy all stem from previous government interventions. They are not a result of “greedy” insurance companies or the healthcare providers. They result from the government imposing the regulations on the insurance companies who then impose them on the physicians and finally the patients. This form of socialism, fascism, practiced now by the government meddlers allows for nominal ownership of the insurance company or medical practice with the government imposing its coercive interference by the threat of that pesky bayonet. He'll then declare that his program in place selflessly gives us the healthcare we deserve. They’ll claim it is for our own good as Alan Greenspans’ shrill wife, Andrea Mitchell stated in one of her news editorials.

We American’s want no more government coercive monopolies in the economy. Instead, true healthcare reform consists of the government abandoning this attempted confiscation of the careers and the goods and services offered by physicians, hospitals and pharmacies. Slavery never works because it is impractical and above all immoral. Altruist solutions are immoral because altruism is the moral base for slavery. Altruism is the morality of the Third Reich, the 9/11 hijackers, Soviet Russia, and savages. It is to be shunned. America politicians must abandon walking in these footsteps. It is moral to be free--free from the initiation of physical force by others and especially by the government sworn to protect us for these very acts. The solution to healthcare reform is not in a compromise placing that bayonet in a leg or an arm and not running us through immediately. True healthcare reform consists of returning completely to the free market by abandoning this attempt at slavery of physicians. This includes abandoning and closing the VA and replacing that with a veterans voucher system and a capitalist approach to medicine and gradually phasing out Medicare. It is the only program that our elected representatives should support. No compromises will suffice. They do not have the right or the constitutional mandate to help the current occupant of the White House in his lust to sacrifice us. They are required to defend our individual rights to life, liberty, property, and the pursuit of happiness. We as Americans expect this of them.
