Hello,
As a representative of our hospital to the Organized Medical Staff Section of the AMA, I introduced a resolution today about physician Tax-credit for uncompensated care provided specifically to the uninsured low-income patients. Instead of government providing insurance to this segment of the population and fund this thru taxation or additional printing of money that will increase our national debt and depress the value of U.S.$., providing tax-credit is budget-neutral. Fortunatelly the OMSS passed this resolution., with the help of Dr. A. Goyal, Dennis Mallory and Edgar Borda. Hopefully, it will pass the House of Delegates.

The AMA has a policy of "mandate for all to buy health insurance". I do not agree with this unfunded mandate per se , but also because failure to buy insurance incurs a penalty of $2,500 and/or 5 years jail-time. I then introduced an amendment to the Health System Reform resolution at the OMSS, that "...the AMA takes a stand, that, before implementation of this mandate to buy individual health insurance, it must pass consitutional muster of the U.S. Supreme Court." I thought this is the least we can do and a modicum of propriety and respect for our Founding Fathers, as the majority in Congress aligned with the White House, is taking 1/6 of the economy under their control. It is not about the AMA itself, taking this directly to the Supreme Court, but , rather, just taking a stand. Hopefully, if passed, that 'amicus brief" can come thru AMA to support anybody or group who may choose to challenge the constitutionality of mandate. Also, since the Constitution is the only recourse to buck this majority in Congress and White House, enumerated powers of these branches of government can only be addressed by the Supreme Court. Remember that a Constitutional republic that we have can negate the coercive powers of the majority. Unfortunately, this amendment failed.....to my chagrin.
