House Democrats "are in disarray" according to Congressman Mike Pence and are still 5-10 "yes" votes short.
- They were forced to release an incomplete CBO analysis this morning in their desperate attempt to pass their healthcare bill by Sunday.
- President Obama has also canceled his trip to Asia set for Sunday.
- The Senate Budget Committee Chairman is openly questioning whether the Senate can pass the House reconciliation bill without any changes.
- The Slaughter Solution is seen by some key Democrats as a "poison."
- A key Democrat, Michael Arcuri (D-NY), has switched from a "yes" to a "no."
- Ways & Means has released a report detailing the "massive expansion of IRS power" under the pending bill.

Also citizens are gathering again in DC on Saturday for another "Code Red Rally" to kill the bill.
The 154 page House "Reconciliation Bill has also been released.
The big difference that needs to be reconciled—abortion funding—is absent. Apparently, the Speaker is just telling pro-life Democrats that they lost, tough, just vote for it anyway.
Instead, the 154 pages contains a lot about cellulosic biofuels, student loans, more taxes, more subsidies, more temporary federal funding for permanently increased state obligations, and more rules that you’ll need a tax accountant and tax lawyer to figure out. But don’t make any plans for your business, because things could change.
It looks as though Sen. Ben Nelson got betrayed; Nebraska no longer gets a permanent exemption from increased Medicaid obligations, and other states get some relief, with the amount based on whether they are “expansion” states or “non-expansion” states. (A two-tiered subsidy system?) Of course, Sen. Nelson can’t change his vote at this point.

The most revealing is probably this:
“Ignore the naysayers posting here! Is this a perfect bill? No! Is it a start? Yes! Why? Once government gets its foot in the door of regulating the health insurance industry you will never get them out of it. It will grow, and grow and grow. Eventually, it will become single-payer which is what I want. Period. I don't give a damn how many deals have to be made, etc. Just pass a healthcare bill and it's over with. We're on our way to joining the rest of the civilized world when it comes to how we pay for healthcare. YAY!”
In other words, the goal is to pass something, anything, and it will become single payer, once the private sector is destroyed. Maybe that’s why Sen. Kucinich saw the light while riding on Air Force One with Obama.
Unfortunately, the Democrats defeated, 222-203, the effort to force separate vote on Senate Bill.

If you really want to stop the health insurance profit promotion bill, then we should use our most powerful right to hold government accountable. This is our right to present evidence indicating the commission of a crime to a grand jury.
If you are wondering what acts associated with this bill could indicate the commission of any crimes, there are a variety of crimes which should be investigated and prosecuted.
By accepting large amounts of donations from an industry and then passing a bill which provides big gains to that industry in spite of widespread public opposition, it seems that such action shows probable cause that a few crimes may have been committed, such as bribery 18 U.S.C. § 201, unlawful receipt of compensation 18 U.S.C. § 203, and theft of honest services 18 U.S.C. 1346. Violations of each of these laws are felonies.
Also, since there is no legal authority under the U.S. Constitution to require anyone to buy any product or service such as health insurance, the attempts to pass this bill are a conspiracy to violate our rights under color of law in violation of 18 U.S.C. § 241 and if it passes, it would be a violation of our rights under color of law in violation of 18 U.S.C. § 242. Yes, it is a felony when people in government violate our rights under color of law.
Although there certainly is probable cause to start some investigations, as usual, the prosecuting princes haven't noticed that the other members of government are engaging in a pattern of criminal activity. However, there is a way to push for prosecution.
One way to start pushing for this is by using the pertinent part of 18 U.S.C. § 3332(a) which states, "any attorney appearing on behalf of the United States ... receiving information concerning such an alleged offense from any other person shall, if requested by such other person, inform the grand jury of such alleged offense, the identity of such other person, and such attorney’s action or recommendation." I think that if a round of letters was sent to the U.S. Attorneys along with the appropriate request and citation to 18 U.S.C. § 3332 and a petition with hopefully a few thousand people asking for a grand jury investigation of these crimes, then we might just see a dramatic change in direction on this bill especially if it were coupled with a PR push.
Of course, there is no time to gather petitions and ask to present evidence to a grand jury before the vote; however, if Congress sees that this process has started, they may fear facing investigations and indictments and that may cause them to vote against the unconstitutional health care bill.
Hopefully, Take Back Medicine will take the lead in using the law to stop Congress from violating the Constitution once again.
